Bootleg Cards - your thoughts

So I am assuming all the Images used in Dans book (And others) have written releases for thier use...
I mean, The cards do have copyright on them.
If not.... What's the difference?

As a fan... I love them!!
I think the 2003/04 RL CARDZ are great...
The variety of players is good (Instead of the same old 10-12 players)
Getting the majority of the cards year after year....

As far as the Players getting kickbacks, Where does it end?
Do the people who sell signed cards, Jerseys etc on this site give the players or teams who sign them kick backs?
Once again.... I fail see the difference?

I will preface this by saying im no expert in the area and this is what i was advised by a solicitor with my magazine.

The difference is the reason you can take a picture of an item and list it publically on ebay without getting legal threats of copyright infringement. If you take a picture of card (or other item) that you own your not infringing someones copyright - its your image.

If you take someone images (ie a picture a photographer took of a player) and use it then that's a copyright infringement.

Makes perfect sense...
then there is the whole subject release garble as well.
When the paper takes a photo of a person for the paper, That person is asked to sign a waiver so the photographer has the right to publish the picture (Even though it is thier picture) I assume this would be similar at least?
I also don't know the ins and outs of it all....

Yeah im not 100% sure either but i would guess thats its like when paparazzi take a picture of a celebrity and sell it to a magazine.

They are not getting a waiver signed from the celebrity but they would own the copyright to the picture that they took and they could sue anyone that used it without permission.

My thoughts exactly....
I'm a big believer in supporting my club, Which I do...
But I'm also a massive collector, So for mine it's a double edged sword.
My team gets money (A lot of money) from me as a supporter throughout the year.
As a collector I choose what I buy and for how much.... Where it comes from or where it goes,
Doesn't matter to me so much if I love the product.
I have some hand drawn sketches etc from artists over the years.... (Like my Joel Caine Cariciture)
With that being said, If I can buy something I want directly from the club... That's where I get it!!

I am writing a reference book, perfectly legal. Such as a stamp reference book like this one

http://www.booktopia.com.au/stamps-of-australia-alan-b-pitt/prod9780980524840.html

The difference is such as the stamp reference book is the cataloguing of information rather than making and designing your own product, whether it be legally or illegally.

Like the stamp reference book he only reports on official stamps, likewise I only list the official cards released by reputable companies.

Does that mean you'll put the Maggi cards in the Next one Dan?
I remember you saying they from PNG etc, And you only referenced Australian cards...
But they are Australian Players, Playing for Australian teams... Surely that makes them Australian (ish at least)
(Regardless of the Origin)
Carn Dan.... You know you wanna!!

I wasnt intending to include the maggi ones. They are a terrific set. I am running out of room with this book, it is getting a bit TOO big.

I was intending to include nz set which included the warriors as they are part of the nrl. Not including the mid 90's nz sets as they are generally just nz cards.

It would be very handy if it did include the two 90s NZ sets, imo. Although it only has Kiwi and NZ domestic players, most of those Kiwi players were playing in the ARL at the time the set was produced.

The Maggi cards are NRL cards, Featuring NRL players...
To NOT include them is almost criminal!!
Do you have all the info on them Dan?
DK has a pot load of them....

Have you got a checklist Batboy? I have a few of these but I have never finished the set cause I'm not 100% sure what I need.

No mate...
Dunno if anyone knows exactly what's out there.
I remember when DK posted a pic that he had a few from series I'd never seen.
I have the 2004/2005 tigers sets...
But thats it!! :(

I think this is appalling that the players don't get any royalties from these bogus cards, this should be Taffy Smith's No. 1 priority to stamp these bootleggers out of the game for once and all.

Never listened to a burnt Cd Leigh...
Never watched a burnt DVD???
Never had any Mixed tapes back in the day??
Never taped a show on TV, Heck... Never taped the game to watch it later???
..... I would hazard a guess that everyone here has done at some point.
ALL these things breach the same laws / copyrights as discussed here.
So before y'all grab your torches and pitchforks and head out on a witch hunt,
Ya might wanna expand your thinking a little...
The beast is too big, And decades old!!
It's in Film, Music, Basically all types of Media...
Everone here, has at some point dudded someone out of some entitlements, Without blinking an eyelid...
If you don't like the idea, Don't support it... Simple

And that's without even mentioning Sig hoarders who sell items... Can't imagine they're giving the players a kick back!!

There's a difference between say downloading a new tv show and profiting from someone else's copyright. The punishments if you get caught reflect that.

It's like me saying "Oh well, that guy on ebay makes trading cards without permission and gets away with it, that's illegal, so I guess I can go and murder 50 people now."

Which I would dearly love to do ... ahem. Nothing!
