Paypal Claim..what do you think my chances are?

OK, here's the deal. I have lodged a paypal claim for non receipt for some cards I purchased late November and asked for the seller to provide a tracking number.

When I gotr the tracking number and did the search through the USPS website it said that the package had been delivered in 2008 in Norway of all places. Seller claimed that tracking numbers were re-used.

Had Matt (ShawnBradleyFan) check this out to find not true.

Lodged a paypal claim and seller has escalated to investigation and is now stating was only a customes number they provided not a tracking number. Is also saying that cards were sent flat rate international so can not have a tracking number.

What do you think my chances are of winning the claim. The purchase was not an ebay purchase (although they were on ebay and I forgot to bid and they did not sell) nor through a forum.

Will probably do a charge back on my credit card as well
 
I put a claim in for something i did not receive from ebay.. and worked in my favour... They are very good.. I wish u luck, sounds like u will get back.

Yep agree'd you should be fine on this one Garth. Unless there is proof the card arrived at your place he doesn't have a leg to stand on.
 
You should get it back Garth. The seller usually has to provide proof of delivery in the way of a tracking number to cover their backsides, don't they? They should find in your favor mate, they normally do with situations like this from what I understand.
 
I put a claim in for something i did not receive from ebay.. and worked in my favour... They are very good.. I wish u luck, sounds like u will get back.

Yeh, what a rip off :woot::woot: If the buyer doesn't request registered post it should not effect the seller. How can the seller be held responsible for something once it leaves his hands, if the buyer is to tight to request registered post. What a crock.

Also, the listed postage is actually for POSTAGE/HANDLING/FEES as per ebay SOPS.

Anyhow, yes, if the postage is way in excess of the orginal listed price I would contest that privately with the seller.
Having said all that. If you liked the card and the seller has more to list, forget about it. Sellers can no longer leave negative feedback but thay can definetly block problem buyers from bidding on their items :D:D:D:D

How do we know that the seller sent it? or how do we know the buyer isn't a scam artist? no reference to anyone here, As i have said before anything i sell on ebay and buyers pays via PayPal MUST pay for registered Post, i make this clear in the auction this this kills off both scenario's of claiming i didn't receive, or i sent the item...

Paypal doesn't protect sellers unless they use registered postage, which is why a lot of sellers on ebay won't ship internationally now - too many claims.
Sounds you like will be getting your money back...
 
From the moment the seller sent you an old tracking thats it, hes done for.

USPS, in fact no delivery company ever reuses delivery numbers, thats just ridiculous.

Depends on whether he is still selling on ebay and has a paypal account. He could have closed his account off. But i think if the paypal claim is lodged when he has sufficient funds, it freezes those claimed monies. So you should be okay in that case.

Yeh mate, thats the only way around it but it's a pain when you miss the postie and have to go into town just for a few cards. ( I realise you can wait till shopping etc) Also, if you buy heaps of cards etc, regi post for every buyer really isn't practical.

Insufficient funds, then it comes out of credit card. You have to have a credit card to sign up.

sorry to hear this happen to you mate. Let me tell u what i think is gonna happen:

PAYPAL will persue their "investigation" and drop the dispute with the conclusion "NOT ENOUGH EVIDENCE - LACK OF EVIDENCE" bs. so this means you will not get your money back unfortunetly and that will be the end of the dispute. its happened to me a couple of times.

however i do hope you get your money back atleast, but honestly if it wasnt VIA EBAY CHECKOUT PURCAHSE, then i dont think u have much of a chance.

The funds might have been withdrawn from their paypal account but most of ther purchase was paid with using credit card so can still do a chargeback

One other thing, they are still selling on ebay and their last auction started before I lodged the claim mentioned no overseas buyers as too many problems..seems strange to do that before the claim was even lodged, sounds like they were expecting this to happen

look yeh im with ya all the way mate, but im telling ya anything outside of ebay your chances of getting your money back are slim to none, seriously. ive seen tracking numbers, receipts, the whole 9 yards, and in the end paypal close the dispute stating "insufficient evidence to claim/proceed". i certainly do pray im wrong on this one, but from experiecne its happened to me 3 times now. even if the other guys still selling on ebay, it has nothing to do with that according to paypal mate.

the only thing you could do is go to your bank and file a chargeback. thats literally the only other option you have (assuming the dispute is closed and goes how im saying im thinking it will). all the best though with it, just us posted on what happens so that way people can possibly learn for any future cases that are similar which happen to them.

A quick update for those interested. The seller has chosen to escalate the claim. They have also openly stated that they did not send with a tracking number.

Paypal have requested more info from them
