Personally I don't think you should leave negative feedback - however, perhaps a new rule should come of this where there is no trading on behalf of friends or family members.
Trust me, I am very reluctant to give tiphaine a negative as well and will not make a harsh decision. I will give it till this weekend and really hope she sorts it out with friend by then.
If it was me i wouldn't be interested in anything but returning the card for a full refund. The card may still be worth 75% of its original price, but i would not have been interested in it or bought it in the condition it is. I think most people are not interested in buying damaged cards even at a discounted price.
As for leaving negative feedback, i think the seller is responsible for any deals they make whether it is for them or their friend. They have ultimately made that decision and if there are problems with the deal then it is their problem and a chance they have taken selling for a friend. If there ends up being a problem with the deal then they should work it out or wear the negative feedback. As someone who has had all positive trading experiences and feedback on here but less than 20 feedback score i assume if i was in the same situation and said i had been selling for a friend that i wouldn't be given the same leniency.

You are pretty much spot on here I think, however the things to consider are:
Alex asked for a partial refund, therefore he IS interested in keeping the card at a discounted price, so that is no issue.
Tiphaine (la iph) is constantky on here and other forums doing exactly this sort of thing all the time and it is in no way for her own benefit, but purely to help people out. She has spent a lot of time looking around European sites for cards for me personally. Also, she has acted as mediator on many deals for me in the past, so it is not an excuse by any means. This is why I am putting my hand up to help compensate Alex for his loss, no question!
At the end of the day, this IS a genuine case of getting caught up and possibly punished for trying to help someone. A negative feedback would ONLY discourage people from trying to help other people in the future!
I would really like tiphaine to sort it out first and of course like to give her options on how she like to rectify the situation. However, it may be completely out of her hands if her friend refuses to co-operate. I'll try to keep everybody posted when she hears back from her friend.

g) Selling or trading card(s) or boxes that you don't have in hand is not allowed. You must have the card(s)/boxes in hand before they can be included in a deal. This includes presales of cases unless approved under point (h)
Tiphaine and I managed to work out a resolution throughout the night... Well I suppose it was day time for tiphaine.
Tiphaine opted to do the partial refund which I am satisfied enough to cause no further grief.
Look I must say this is really a bizarre situation of a top notch member being blind sided by a good friend. And even though, tiphaine took awhile to comprehend the situation, she didn't have the heart to let any member in OCT down. I really like to commend her on that and also thank those who (especially drob50) kept reminding me on how good she is.
I now rest my case. And as the new title suggest, I will be leaving her a positive feedback instead. Cheers
To play a little bit of devil's advocate... from my experience, never ever pay with gift/no protection to France. Had you not paid gift you would have likely been fine. It was being registered anyway, why did they need to insist on that?
Glad it got worked out for you but people need to be more careful with their money.

Just asking from your experience, even if you pay through the normal "goods" payment, there is nothing much you can do. It is not as if paypal will refund you the money immediately. The seller's money will get frozen until a resolution can be found. Is that right?

You would have to file a claim, and go through the process there, but at least then you might get a resolution if the seller refuses to comply/compensate. Nothing would be immediate.
