Offering and needing advice

Hey guys! Just wanted to offer a warning and at the same time seek some of your opinion. I won a bid on ebay (Aus) for a card. The transaction and communication was all well and fine. The card came in my mailbox today but it was in an Auspost clear bag. Apparently, while sorting through the mail using their 'hi tech' mail sorter or something. The casing was smashed and hence, destroyed the card.The seller packed the card in a normal paper envelope so it obviously was shredded to ribbons too.
<insert expletives here...>

My advice for sellers and buys - Make sure it is clear how the card will be packed and posted in future transactions

Needing advice - Is there anything I can do to get my money back from post ppl or the seller? The latter is unlikely as it is not really his fault, right? As for the former option, getting money from the Aus post is probably as unlikely as me outrunning Chris Judd.

So what should I do guys? The card cost me 30 AUD (BV is 30 USD) which is still not extremely dear but I have more or less accepted the fact in writing the card off.

Damn, sounds nasty....

Really not sure where you stand, knowing that Aust Post f-cked the card up, but considering the illustrious paper envelope was used, you may well have a leg or 2 to stand on...

You can actually get refunds from the Post Office when they make an error. My girl ordered some balls of wool, the package was left at our doorstep....went missing, and was then returned to our doorstep missing one ball of wool. Because Aus Post are not meant to leave packages without handing it to a person at the residence, she was able to get refunded for the price of the wool and postage. So I'd check with Aus Post first, then maybe with the seller?

I'd be talking to the Seller cos they f-cked up using a paper envelope.
It wouldnt have gone thru the rollers n shit if they used a bubble mailer.

It's not remotely Aussie Posts fault, why should they give a stuff. The card was posted in a hard case, then in a regular envelope. Regular envelopes go through the sorting machines, so of course the hard case is going to get smashed to shit. The seller should refund you, it was he who ****ed up. If he's not prepared to, paypal claim him and negative him.

But if you think about it. If you were the seller and the same scenario happens to you. Will you pay? I suspect not.

that sucks man, but at the same time the seller shouldn't have sent the card in a white envelope, i would try and work something out with the seller.

Man, that's a tough break indeed.

However, this is why I have been relcutant to trade or sell for over 13 years plus, until I hit these boards.
Sometimes, no matter how good an intention you try to do, it just isn't good enough for the person on the other end. Period.

Well, he just emailed me with this reply

'Hey man, I'm so sorry, but the plastic casing holds up to a lot. If you hit one with a hammer it does not crack and crumble, hence why I sent it in the plastic casing, so someone had fun throwing it around the post room or something. I've sent cards with no protection (read my last positive read back) and that was just in the mail, cards only, no bubble wrap or anything. I guess its a long way to WA. Sorry again my friend but hope your still happy with the card.''

and my reply is

'The thing is this. You should not have used a paper envelope because the letter will be treated as a normal paper mail and sent through the sorting machine.
The entire casing was shattered and the envelope was ripped to shreds. The card was badly scratched.
It is an unfortunate but in all fairness, would you consider a refund or at least provide me with an alternative please? '

Well, he obviously thinks nothing of this predicament of mine.

You've done the best thing.

And to answer the question about being in the same position as the seller, I'd not have sent the card in a white envelope.

I think I did that once, it was the first time I'd sent anything Internationally, and I asked the PO what the best way to send was.

The buyer got it ok, but did email me and suggest I not do it that way any more.

Here at OzCards, we have rules on shipping, and would expect that everyone at LEAST use a bit of initiative when sending cards. People who send in paper envelopes are cheap, and are obviously taking your postage costs and using it as their fees for listing their cards on Ebay. It's like $1.80 to post a card in a bubble mailer Aust. Wide! No excuses.

Wouldn't happen to me, I don't ship cards in white envelopes, and if I did I'd accept the blame.

Well, here is the reply and it has taken an even more nasty turn.

His reply (in his own spelling and words)

Hey man, I've just spoken to my brother in law who works at australia post and he said that it is impossible that this would happen, so why would you lye to me my freind?

And my reply is as follows
'Hi there! Let's make this clear. I have absolutely no intention to lie to you. Honestly. I am a keen collector. Would you like me to take pictures of the clear Aus Post bag, the words written on it, the shredded envelope, the smashed casing and scratched card for you to see? I have dealt with so many sellers and had no such problems.

Look man. I have no problem if you think you are not required to pay but the last thing you should do is question my integrity.

Do you also want to ask your bro in law what I should then since the fact is that this happened?

Seriously ay? Calling someone a liar without ascertaining the truth is not on ok? '

Alright. What do you guys reckon? I have sent a dispute claim to Ebay and will go to my local post to see what they say.

Hahaha.... I hope you guys don't think I am some whinging azz. Just wanted to let off some steam with ppl who can understand and empathise. Plus let it be a reminder for everyone too.

Nothing makes me cringe more than looking at an auto card (limited to only 50) defaced like that. I am sure many of you guys will feel the same agony right?:smt013

Anyway, I am more or less resigned to it being a write off.
