Hi i sold a card on ebay and sent it ems on the 15th to New York,
there was an attempted delivery on the 19th twice
since then nothing and now i have a case against me as they haven't received it,
and they've said they even went to post office but there was no info for them,

what is my next step?
or do i have to lose card and give refund

I would advise them that you will attempt to track it from your end and to give you a day or two, then get in contact with EMS.

What type of service is it? Signature on delivery?

yes signature on delivery by express courier
on the usps site it says they left note

So if the note has been left, that means that USPS still has the package! I would send them an email with the tracking number and ask them to confirm that they have it!

yeah i tried to email usps but you need a us address, hopefully tomorrow auspost can help

If you have tracked the item on the USPS website, tell your buyer to do the same, so he can see the evidence himself. I don't see how the post office can reject this guy when there is evidence that the delivery was attempted

Then you have to go after USPS via Austpost complaint process, this can be very slow. The last time I went through them, USPS has 60 days to come up with a response to find an item.

But anyway, don't give the guy a single dollar, he maybe trying to pull some tricks. He may have changed his mind on purchasing your item, so now he wants it returned to sender.

the card arrived back ok today
