I've yet to see a good argument why the injury the tackle causes shouldn't be taken into account when handing out a judiciary sentence. It's not like a drunk driver who almost knocks over a pedestrian but they jump out the way and avoid injury gets the same penalty as one who knocks over a pedestrian and kills them, why is league a special case?

Anyway, it's written into the NRL judiciary that injury does have an impact on the sentence, so if you disagree you pretty much need to get over it.

Kade Snowden got eight weeks last year coz he broke a players jaw in a nothing tackle. Given that, I think McLean has been pretty fortunate.

in certain situations, i think so, the reynolds one is clearly a dive. and i think inglis did it alot last year too, i remember at the time alot of people thought he was diving and alot thought it was ridiculous. but the question was why is it always inglis whos getting dumped on his head, because it happened like 6 times in the space of 3 weeks with inu, faoso and someone else. and the answer was because he was doing it to himself i think.

I believe some people do too.. I play league myself and have done since I was 11, if someone lifts me by one leg, I make an educated guess as to the risk, and get myself past the horizontal and get the penalty.. Lifting the leg is illegal and I'll take the penalty any day...

My 2 cents worth is Reynolds dived. Inglis I'm not too sure as he's a tall, top heavy guy. Tacklers need to have a feel for the tackle. I think the rules state that if an attacking player goes past the horizontal then it is deemed dangerous. The McKinnon tackle was only just beyond this. The compounding factors were the tucking-in of his chin PLUS the weight of the 2 other players involved in the tackle. Hence I don't believe McClean should wear all the responsibility.
I think the NRL should have some sort of compensation fund set up for these devastating injuries, much like James Hardie and their asbestosis claims. In terms of precedence you could look at the Adam Ritson case (although a bit different) and the Jarrod McCracken case. In both of these situations an incorrect tackle led to premature retirement.

I thought the clubs had insurance for players?? They do for A-League.

TBH I have no clue if they do or not. It may be difficult to find insurance given the inherent risk in playing the game. They could get income protection insurance easier I would imagine

Nope, I'm not biased. Plenty of people said the same at the time, Phil Gould was one I recall. Snowden braced for collision and the shoulder made contact with the face, but it wasn't a charge.

McLean's tackle would have been just as innocuous if there wasn't an injury ... but with the outcome, he always had to be punished for that.

You'd think the Players Association or at least the Players Managers (who bleat on about client welfare) would ensure all the players had insurances of some sort to cover the cost of this. Hell, the NRL could get in to bed with a medical insurer, allow the insurer free advertising in things like Big League, match coverage and match day, etc and in return the medical insurer looks after player welfare.

If they can get a code wide drink sponsor in Gatorade, surely they can get a code wide medical insurer on side?!

With Australia being a fairly litigious county, insurance companies are prob very nervous about insuring this lot. Around 2000, the main insurer that covers GP's went bust as did some big companies such as HIH that Packer AND Murdoch were involved in. Unfortunately we like to play the blame game as can be seen by some posts in this thread. As such someone MUST be accountable. Even though there are multiple factors in poor Alex's condition due to a very unfortunate accident, SOMEONE still has to be blamed which is not necessarily right

Hi guys havent been on this site for a while and i just feel sorry for all parties involved im sure nobody goes out to break anothers players neck.
Yes you do go out to smash the opposition as an old player years ago.
Hope alex makes a full recovery,but i still feel for the young bloke who has to live with this.
anyway just my 2cents worth.

With the Beau Falloon tackle, again there was a lifting action but we do not feel he is put in a position where it is likely his head or neck will make first contact with the ground.

This is the biggest issue with the judiciary a complete lack of consistency. Fortunately no one got seriously hurt but if Jordan McLean got 3 weeks for his tackle on Alex (and 4 weeks for the injury) Then really there should be 3 weeks for the tackle above.
